Washington’s Department of Fish and Wildlife will formally acknowledge Friday that it violated the constitutional rights of two brothers who commercially fished the Columbia River. The agency’s admission of wrongdoing is part of a settlement in a lawsuit that has changed agency practices. It stems from a traffic stop nearly nine years ago in rural southwest Washington. The traffic stop happened on the morning of March 23, 2007. The location was tiny Wahkiakum County across the Columbia River from Astoria. It was captured on video. Read the article here 12:52

Fish and Wildlife Captain Michael Cenci and his subordinates have followed the Tarabochias, detained them without cause, confronted them on their fishing boat and threatened them on several occasions with various criminal charges. In 2006, the brothers made a formal complaint to the local prosecutor who invited Cenci to discuss the issue in a meeting. Court documents claim Department of Fish and Wildlife (DFW) officers have stopped members of the Tarabochia family dozens of times since 2000, filing 27 criminal counts in 11 separate cases in four counties without ever obtaining a conviction. DFW Deputy Chief Mike Cenci, a defendant in the lawsuit, denies the family’s allegations of a “vendetta.” But he added: “You don’t know this family. It took me a while to decide how to most accurately describe the situation that has been visited upon the New England fishing communities that are and since colonial times have been dependent on the groundfish fisheries.

While it’s a fact that’s hardly ever acknowledged, the assumption in fisheries management is that if the population of a stock of fish isn’t at some arbitrary level, it’s because of too much fishing. Hence the term “overfished.” Hence the mandated knee jerk reaction of the fisheries managers to not enough fish; cut back on fishing. What of other factors? They don’t count. It’s all about fishing, because fishing is all that the managers can control; it’s their Maslow’s Hammer. When it comes to the oceans it seems as if it’s about all that the industry connected mega-foundations that support the anti-fishing ENGOs with hundreds of millions of dollars a year in “donations” are interested in controlling.
