Sipekne’katik First Nation’s lobster study to assess impact of summer and fall fishing

The boat, Mamma Ain’t Happy, is owned by Sipekne’katik First Nation and is fishing under food, social, and ceremonial (FSC) tags. The tags are the licence under which the lobster can legally be fished and allow the band to harvest it for those purposes but not to sell it. After each trip, the catch is brought back to the community for lobster giveaways that feed most of the families in the second-largest Mi’kmaw band in Nova Scotia.  But this boat doesn’t just fish for people’s supper. Indigenous fishermen hope to be arrested, trigger court case as Nova Scotia lobster season kicks off

As one of the most lucrative fisheries in Canada prepares for opening day, some Mi’kmaq in Nova Scotia are trying to trigger a court battle over Indigenous fishing, hoping it will see them win a greater share of the thriving lobster business. And they are daring the Department of Fisheries and Oceans to arrest them. One of them is Cheryl Maloney, an activist, law school graduate and mother of four boys. She wants her family to be able to earn the “moderate livelihood” she says the Supreme Court of Canada ruled they are entitled to in 1999. click here to read the story 09:19

Mi’kmaq woman to challenge lobster fishing rules

Cheryl Maloney is gearing up to go lobster fishing. She doesn’t have a commercial licence and she won’t be using one of the food and ceremonial purposes tags she is eligible for as a member of the Sipekne’katik First Nation. What the longtime organizer for indigenous and women’s rights has is a 1999 Supreme Court decision stating that she has the treaty right to make a “moderate livelihood” off the resources the Mi’kmaq traditionally exploited. When she lands her lobster on a South Shore wharf, Maloney plans to invite Fisheries and Oceans Canada and the RCMP to come and watch her sell them. click here to read the story 11:15
