4 lawsuits threaten Vineyard Wind

The lawsuits against America’s first major offshore wind project are coming to a head. Four cases are challenging the federal environmental permit issued to Vineyard Wind, a 62-turbine facility being planned for construction in the waters off Martha’s Vineyard. A federal judge in Massachusetts heard arguments brought by landowners in two cases in recent weeks. The other two suits, brought by fishing groups, have been consolidated and will appear before the same judge for oral arguments in Boston on Monday. Judge dismisses case to ban lobster lines, but opens door to future right whale protections

A federal judge may have delivered the legal roadmap to ban lobstermen from using vertical buoy lines in a long-awaited ruling this week. The case centered around concerns that the lines, authorized by the state of Massachusetts, entangle and kill critically endangered North Atlantic right whales. But Judge Indira Talwani dismissed the case because, she wrote, the plaintiff Max Strahan, a controversial whale advocate, had questionable credibility in some instances and failed to prove that he has a personal stake, or standing, in the case, a critical component of the lawsuit. >click to read< 12:37

North Atlantic Right Whale: State must secure incidental take permit within 90 days to to avoid fishery closures

Last week, U.S. District Court Judge Indira Talwani said that Massachusetts has done the most of any state in the country to keep endangered North Atlantic right whales from becoming entangled in lobster pot and gillnet lines.,, In her April 30 decision, Talwani postponed ruling on closing fisheries, but gave the state just 90 days to obtain an incidental take permit under the Endangered Species Act from the National Oceanic and Atmospheric Administration. On Monday, a federal judge in Maine ruled that a similar suit could proceed, denying NOAA’s motion to dismiss.
