Commercial fisherman sentenced to 6 months in prison for falsifying fishing records and taking an endangered sperm whale
A Southeast Alaska commercial fisherman was sentenced today to six months in prison for falsifying fishing records in violation of the Lacey Act and illegally taking a sperm whale in violation of the Endangered Species Act. According to court documents, between October and November 2020, Dugan Paul Daniels, 55, of Coffman Cove, knowingly submitted false records about his commercial fishing activities to make it appear that he lawfully caught sablefish, aka “black cod,” in federal waters on two separate occasions. An investigation revealed he harvested the fish illegally in State of Alaska waters, specifically, in Chatham Strait and Clarence Strait, respectively. Alaska fisherman could get six months in prison after attempting to kill sperm whale
Federal prosecutors are recommending that an Alaska fisher serve six months in prison, pay a $25,000 fine and be banned from commercial fishing for a year after lying about fishing catches and trying to kill an endangered sperm whale. Dugan Paul Daniels pleaded guilty to a federal misdemeanor earlier this year, and prosecutors released their sentencing recommendation on Tuesday. According to court documents, Daniels became infuriated in March 2020 when a whale began taking fish from his longline fishing gear and damaging equipment. There are “Gilligan’s Island” plots less far-fetched than the twists and turns it took to navigate a local commercial fishing boat skipper’s case to the U.S. Supreme Court.
