“Disabilities last a lifetime” – DFO must consider fisherman’s charter rights in licence fight

Dana Robinson of Parkers Cove has a medical condition affecting his leg that hinders his ability to stand on a boat for long periods of time. His boat was operating in the Bay of Fundy under a DFO provision that allows fishermen to designate a substitute operator once they provide adequate medical proof of their condition. Alleging disability discrimination, lobster fisherman taking DFO to Federal Court

Longtime Nova Scotia lobster fisher Dana Robinson was hoping to pass on his fishing licence to his grandchildren. Robinson bought the licence to fish in Area 35 on the Bay of Fundy in 1998, more than 20 years after he began fishing at the age of 16. Today, chronic circulation problems in his legs necessitating a number of surgeries have left him medically unable to withstand the physical toll of being out on the vessel,,, But due to a federal owner-operator policy, the Fisheries and Oceans Canada (DFO) has informed Robinson that if he can’t fish the licence himself, he must sell it. Disabled fisherman fights ‘arbitrary’ 5-year limit on substitute fishermen

A disabled Nova Scotia fisherman says he will continue challenging a federal rule that will prevent him from hiring someone to catch lobster under his licence. Dana Robinson lives in Granville Ferry, N.S., and has had an owner-operator licence to fish in the Bay of Fundy, Area 35, since 2007. But due to a medical condition, he’s no longer able to stand for more than a few hours a day and can’t operate his boat himself. Fisherman claims DFO policy discriminates against disabled fishermen

A lobster fisherman from Granville Ferry is suing the federal government, claiming one of its licensing policies discriminates against disabled fishermen and is therefore unconstitutional. In a lawsuit filed Friday in Nova Scotia Supreme Court, Dana Robinson says the Department of Fisheries and Oceans can authorize a substitute to fish a licence if the owner has a medical condition, but that authorization expires after five years. click here to read the story 16:31
