Moderate livelihood treaty right at centre of fishery trial in Nova Scotia

A trial involving three Mi’kmaw fishermen who say they were exercising their treaty right to fish for a living when they were charged with fishery offences is currently underway in Digby, N.S. James Nevin, 38, Logan Pierro-Howe, 24, and Leon Knockwood, 27, from the Sipekne’katik First Nation are each charged with four counts of violating the Aboriginal Communal Fishing Licenses Regulations and the Atlantic Fishery Regulations under the Fisheries Act. They’re accused of fishing and catching lobster without authorization as well as possessing lobster traps that either had unauthorized tags or no tags on them. >click to read< 08:10

Investigation leads to 66 halibut fishing charges in Nova Scotia

As a result of a 24-month major case investigation in the Sambro area of Nova Scotia, Fisheries and Oceans Canada has laid 66 charges related to the illegal possession and sale of harvested halibut. On December 13, a total of 41 charges were laid at the Halifax Provincial Court for offences under the Fisheries Act and the Atlantic Fishery Regulations, 1985. This is in addition to a total of 25 charges which were laid on January 7, 2021. It took me a while to decide how to most accurately describe the situation that has been visited upon the New England fishing communities that are and since colonial times have been dependent on the groundfish fisheries.

While it’s a fact that’s hardly ever acknowledged, the assumption in fisheries management is that if the population of a stock of fish isn’t at some arbitrary level, it’s because of too much fishing. Hence the term “overfished.” Hence the mandated knee jerk reaction of the fisheries managers to not enough fish; cut back on fishing. What of other factors? They don’t count. It’s all about fishing, because fishing is all that the managers can control; it’s their Maslow’s Hammer. When it comes to the oceans it seems as if it’s about all that the industry connected mega-foundations that support the anti-fishing ENGOs with hundreds of millions of dollars a year in “donations” are interested in controlling.
