Mi’kmaw fisher hopes his treaty rights will prevail at trial

Matt Cope has already told the court that he was harvesting lobster in August 2020 when he was charged. While the fisher from Millbrook First Nation admits to that – Cope, 36, says his treaty rights should protect him from a conviction. Cope appeared at the provincial court in Digby, Nova Scotia where the Crown proved he violated the fisheries act. Officials with the Department of Fisheries and Oceans, also known as DFO, testified that on Aug. 28 and 29, 2020, they seized 90 lobster traps from the Bay of Fundy. Video, >click to read< 11:09

A Mi’kmaw lobster harvester wants to know what happened to his lobster after finally getting his fishing gear back from DFO,,, The gear had been sitting in a federal fisheries compound since then, and Matt Cope of Millbrook First Nation spent months trying to get it back. When Cope unloaded his gear this week, he was shocked to find damaged traps with ropes cut. “Traps aren’t cheap, ropes not cheap,” he said. “When they’re taking it for months at a time, and just all of a sudden giving it back when it’s all damaged, there’s no way we can fish like that.” >click to read< 08:50

It took me a while to decide how to most accurately describe the situation that has been visited upon the New England fishing communities that are and since colonial times have been dependent on the groundfish fisheries.

While it’s a fact that’s hardly ever acknowledged, the assumption in fisheries management is that if the population of a stock of fish isn’t at some arbitrary level, it’s because of too much fishing. Hence the term “overfished.” Hence the mandated knee jerk reaction of the fisheries managers to not enough fish; cut back on fishing. What of other factors? They don’t count. It’s all about fishing, because fishing is all that the managers can control; it’s their Maslow’s Hammer. When it comes to the oceans it seems as if it’s about all that the industry connected mega-foundations that support the anti-fishing ENGOs with hundreds of millions of dollars a year in “donations” are interested in controlling.
