Alaska Supreme Court upholds $20,000 fine for Metlakatla fisherman in fishing rights case

The Alaska Supreme Court has upheld the conviction of a Metlakatla fisherman who was fined for fishing without the proper permits. The case is part of a long-running dispute over tribal sovereignty. In 2014, U.S. Coast Guard officers reported a Metlakatla tribal member fishing in a closed area without a state commercial fishing permit. When they boarded the boat they found a few dozen coho salmon, which the skipper reportedly said he intended to sell. Metlakatla resident John Scudero Jr. was cited for three commercial fishing violations and fined $20,000 after a one-day trial the following year. >click to read< 08:27

Illegal trawling trial concludes after 10-month hiatus

Fishing company Amaltal has maintained its position that a vessel found trawling in an unauthorised area was the fault of the skipper and not the company. Amaltal, the deepwater division of Talley’s Group, and skipper Charles Shuttleworth are on trial in the Nelson District Court for allegedly trawling in an area closed to fishing in the Lord Howe Rise in the Tasman Sea – from an incident in May 2018.,, The Amaltal F/V Apollo left Nelson in May 2018, on a trip to fish for orange roughy and alfonsino. Dimed Out! Call Leads to the Bust of Commercial Prawn Harvester fishing in a closed area

Hai A. Trinh was found guilty in Powell River Provincial Court for fishing in a closed area of Desolation Sound, retaining undersize prawns, and other violations of the Fisheries Act. The Honourable Justice Leven Wingham ordered the commercial prawn harvester to pay a fine of $30,000 and forfeit the value of his catch, which sold for $12,630. On June 18, 2019, fishery officers received information from the public about a commercial prawn fishing vessel operating in a closed area. >click to read< 17:18

It took me a while to decide how to most accurately describe the situation that has been visited upon the New England fishing communities that are and since colonial times have been dependent on the groundfish fisheries.

While it’s a fact that’s hardly ever acknowledged, the assumption in fisheries management is that if the population of a stock of fish isn’t at some arbitrary level, it’s because of too much fishing. Hence the term “overfished.” Hence the mandated knee jerk reaction of the fisheries managers to not enough fish; cut back on fishing. What of other factors? They don’t count. It’s all about fishing, because fishing is all that the managers can control; it’s their Maslow’s Hammer. When it comes to the oceans it seems as if it’s about all that the industry connected mega-foundations that support the anti-fishing ENGOs with hundreds of millions of dollars a year in “donations” are interested in controlling.
