Ocean polluters seek to have convictions overturned

A father-son team that was convicted of polluting Puget Sound and the ocean have asked a judge to toss their convictions. In Seattle federal court on Friday, Bingham Fox asked the judge to throw out his conviction for violating the Clean Water Act. His attorney accused the government of “prosecutorial misconduct.” Fox and his son Randall Fox were convicted of pumping oily bilge water from their 80 fishing vessel “Native Sun.” A deckhand provided the US Coast Guard with a video showing a makeshift pump that pumped engine oil overboard while the vessel was in Blaine harbor. Federal law requires commercial vessels to filter out engine oil and dispose of it properly on shore, which costs time and money. click here to read the story 09:12

Captain of Fishing Vessel Pleads Guilty for Discharging Waste into the Ocean

A captain of the fishing vessel (F/V) Native Sun pleaded guilty Friday in federal court in Seattle, Washington, for discharging oily-waste directly into the ocean in violation of the Act to Prevent Pollution from Ships (APPS) and the federal conspiracy statute. Randall Fox pleaded guilty before U.S. District Court Judge Lasnik of the Western District of Washington to two criminal felony counts for violating APPS’ prohibition against discharging oily-wastes, namely machinery-space bilge water, directly into the ocean. According to court documents, Randall Fox, and other co-conspirators, repeatedly discharged the oil-contaminated bilge water into the ocean using unapproved submersible pumps and hoses. On at least one occasion, such a discharge left a sizable oily-sheen along the surface of the water that trailed alongside the F/V Native Sun. The New England groundfish debacle (Part III): who or what is at fault? Nils E. Stolpe/FishNet

It took me a while to decide how to most accurately describe the situation that has been visited upon the New England fishing communities that are and since colonial times have been dependent on the groundfish fisheries.

While it’s a fact that’s hardly ever acknowledged, the assumption in fisheries management is that if the population of a stock of fish isn’t at some arbitrary level, it’s because of too much fishing. Hence the term “overfished.” Hence the mandated knee jerk reaction of the fisheries managers to not enough fish; cut back on fishing. What of other factors? They don’t count. It’s all about fishing, because fishing is all that the managers can control; it’s their Maslow’s Hammer. When it comes to the oceans it seems as if it’s about all that the industry connected mega-foundations that support the anti-fishing ENGOs with hundreds of millions of dollars a year in “donations” are interested in controlling.
